99squarefoot may refuse to advertise your property or properties at its sole discretion without affording any reason. 99squarefoot may remove any advertised property at any time at its sole discretion without affording any reason.

Any User agrees not to submit any property descriptions, photographs, financial, contact or other information contained in each property's data to 99squarefoot unless the User submitting such a Listing/Advertisement has acquired received all necessary rights and authorizations from the owner of such property or the power-of-attorney holder, including from the photographer and/or copyright owner of any photographs, to publish and advertise the said Property(s) on the User's website or on ‘99squarefoot.

No user should change or remove any copyright notice published on 99squarefoot.Nor should an user misrepresent any information or provide false / inaccurate information regarding any property advertised at 99squarefoot.

An user will not advertise any property using any copyrighted information, or information that you do not have permission to use. AIIPL does not routinely monitor your postings to the web site but reserves the right to do so.

However, if AIIPL becomes aware of an inappropriate use of 99squarefoot or any of its Services, AIIPL will respond in any way that, in its sole discretion.AIIPL reserves all other rights.

99squarefoot offers no guarantee or warrantees that there would be a positive response or any response, once the property is put on display. Any payments made to 99squarefoot in this regard are solely for the purposes of display of the property advertised.

No user will remove an advertisement for a property for at least a period of one week after publishing the same on 99squarefoot.You will not interfere in other users’ enjoyment of the services.

An user will not create links from any website or webpage to any page or site on 99squarefoot, express with 99squarefoot’s express written permission.

99squarefoot may, at its sole discretion and without providing any reasons, suspend your services (even paid services), in case of any violation, or alleged violation, of the terms of this Terms and Conditions and in case of any delayed or non-payment of any amount due to 99squarefoot, for an indefinite period of time. 99squarefoot will not be liable for any damages, costs, losses or other actual or alleged claims in this regard. The user shall indemnify and hold 99squarefoot harmless against any claims or third-party claims as a result of the user’s violation of the Terms and Conditions or non-payment for services provided by 99squarefoot.

‘99squarefoot is not intended to provide financial, investment or real-estate advice. Service may include advertisements.Unless you subscribe to our agent service, we do not act as property agents. We do not represent you or the other users looking for property or advertising their property or properties at 99squarefoot and will not assist any party in the lease or sale / purchase of any property.

‘99squarefoot is not responsible in any way for the outcome of any negotiations you may have with any actual or potential buyer / seller, lessor/lessee, landlord/tenant in relation to any property advertised at ‘99squarefoot. Users, who are buying/renting property/properties through 99squarefoot, must verify details the property/properties as well as its right, title, ownership, lien etc. on their own.

Similarly, in the section of ”Disputed”one can post a property only for legal counselling and not for sale.Here “Disputed Property” means only those poperties that are under litigation.’99squarefoot doesn’t take any ownership, directly or indirectly towards any person whatsoever, with respect to banners hosted on Disputed or Sell section of its website by its users, which are strictly in the nature of sale of space by 99squarefoot & it has not carried out any independent verification on the authenticity or compliance requirements, as may have been required under any law for the time being in force, of such images/ banners/ listings.

You are required to comply with RERDA, the Real Estate (Regulation and Development) Act, 2016 ,LMA( Legal Metrology Act, 2009) and all other regulating laws of Republic of India.

You will not copy and republish / advertise any content advertised at or produced by 99squarefoot.

You will not upload any harmful material on 99squarefoot, including any viruses, worms, malware, spam, pyramid schemes or other fraudulent schemes.99squarefoot may assign or subcontract any or all of its rights and obligations hereunder or under any agreement with any user.

No information contained at 99squarefoot shall constitute an invitation or an offer to invest in any property. Further, nothing published on 99squarefoot should be considered as a recommendation by 99squarefoot.in.

Users may not assign, novate, subcontract or transfer their rights or obligations hereunder or under any agreement(s) with 99squarefoot, without 99squarefoot’s prior written consent.

Users will not permit the posting of a property on 99squarefoot under a name other than the name of a real estate agent who has been duly authorized and engaged by the owner of the property in this regard.

No information contained herein shall constitute an invitation or an offer to invest in 99squarefoot or any of its Affiliates.

99squarefoot is controlled and operated from India and AIIPL makes no representation that the materials are appropriate or will be available for use in anywhere outside India. If you use 99squarefoot from other parts of the world, you are entirely responsible for compliance with all applicable local laws as well as international conventions and treaties.

PAYMENT-CONDITIONS

All Postings are free on 99squarefoot.However in near future AIIPL has the exclusive right to provide both free and paid services.But the third party advertisement is always a paid service.

Payments for the Services offered by 99squarefoot shall be on a 100% advance basis and non refundable and any amount paid shall be appropriated. There is no Refund policy.AIIPL reserves its right to amend / alter or change all or any disclaimers or terms of agreements at any time without any prior notice.

AIIPL uses the maximum safeguards as is possible to ensure that all monetary transactions in the form of electronic transfer does not fall in the wrong hands. AIIPL does not store or keep any credit/debit card/online banking data since the transaction happens on a third-party network not controlled by or accessible to AIIPL, this ensures the maximum security.

COURT-OF-LAW

If there is any dispute between an user/users and AIIPL arising out of use of the website or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of these terms and conditions, the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party identified by AIIPL. Decision of the Arbitrator shall be final and binding on both the parties to the dispute. The seat and venue of arbitration shall be Delhi. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings.Regarding any disputes whatsoever in any territory in India or world either on 99squarefoot or its officials, only the Courts at New Delhi , India will have the exclusive rights to proceed the litigations.

You agree to defend, indemnify, and hold harmless, 99squarefoot and/ or its officers, directors, employees, business partners and agents, from and against any claims, actions legal proceedings etc.

LIABILITIES

AIIPL assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, theft or hacking or destruction or unauthorised access to or alteration of User's data/information.AIIPL shall not be responsible for any problem or technical malfunction on-line-systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problem or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to any User and/or Members or to any other person's computer related to or resulting from participating or downloading materials/information from the website.
